Terms of Service

1. Who We Are & Accepting These Terms
Summit Sports Performance, LLC ("Summit," "we," "us," or "our") operates a youth baseball and athletic training facility in Houston, Texas, as well as this website and the accompanying Player Portal (collectively, the "Service"). By creating an account, making a purchase, booking a reservation, or otherwise using the Service, you agree to be legally bound by these Terms of Service.
2. Accounts & Minors
Accounts may only be created and held by adults (18 years of age or older) who are the parent or legal guardian of the participating minor. Players (minors) do not hold their own accounts. The account holder is solely responsible for providing and managing the player's information, executing all purchases, and managing bookings on their behalf.
You agree to provide accurate, current information and to keep your login credentials secure. You are fully responsible for all activity that occurs under your account.
3. Children's Privacy (COPPA Compliance)
The Service and Player Portal are not directed to children under the age of 13. We do not knowingly collect personal information directly from children. All accounts must be created, managed, and monitored by a parent or legal guardian. If we become aware that we have inadvertently collected personal data directly from a child without parental consent, we will take steps to delete such information immediately.
4. Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal data (including payment processing through third parties like Stripe). By using the Player Portal or our website, you consent to the data practices described in our Privacy Policy.
5. Payments & Convenience Pricing
All online payments are securely processed by Stripe; Summit never views or stores your full credit card or bank account details.
Listed prices are the credit/debit-card prices: a card price is the base service price plus 4%, rounded up to the next whole dollar. Paying by bank transfer (ACH) costs the base price — shown at checkout as a discount off the listed price. Monthly cage memberships are the exception: the membership price is the same regardless of payment method. All totals are clearly displayed before you complete checkout.
Texas sales tax (currently 8.25%) is added at checkout where required by law — on batting-cage rentals, memberships, team commitment deposits, and team semester fees. Private lessons are not taxed, as instructional services.
6. Cage Rentals & Member Free Play
Standard cage rentals are booked in one-hour increments during regular facility hours. When you select a time slot, it is temporarily held in your cart. If the checkout and payment process is not completed within approximately thirty (30) minutes, the system will automatically release the slot back to the public.
Membership free-play sessions are subject to the same schedule and availability, and are strictly limited to one free hour per membership per day.
7. Memberships
Cage memberships are assigned per player and are billed monthly to your saved payment method. Memberships carry a strictly enforced 12-month minimum commitment.
Cancellations: After the initial commitment is fulfilled, the membership continues on a month-to-month basis until canceled. Cancellation requires thirty (30) days' notice via the Player Portal. Any scheduled charges that fall within this notice period remain due.
Pricing & Billing: Founding-Member pricing, where applicable, remains valid only as long as the account stays continuously active. If a membership is canceled or terminated, rejoining will be at the current market rate. If a monthly charge fails, membership benefits and booking privileges are temporarily suspended until the balance is paid.
Agreement: These terms supplement, but do not replace, the full Membership Agreement you legally execute at signup.
8. Private Lessons
Lessons are purchased as prepaid packages of sessions tied to a recurring weekly time slot with a specific coach (one-time lesson bookings are also available). Prepaid lesson credits do not expire.
Autopay: For accounts on autopay plans, your saved payment method will automatically be charged for additional lessons when your balance runs low (as disclosed at the time of purchase) until you cancel autopay in the Player Portal.
Cancellation Policy: If you cancel a scheduled lesson with less than 48 hours' notice, the cancellation will be recorded and the prepaid lesson credit for that session may be forfeited. If Summit or the coach cancels a session, the lesson will be rescheduled and no credit will be lost.
9. Refunds & Credits
Except where explicitly stated in these terms or required by law, all payments for lesson fees and memberships are non-refundable. The only way to use a lesson credit is to book and complete a lesson; once a lesson has been delivered, it is subtracted from your remaining lesson credit balance. If an error occurs with a billing charge or a booking, please contact us immediately so we can reasonably resolve the issue.
10. Assumption of Risk
Baseball and athletic training involve inherent risks, including the risk of severe or permanent injury. By enrolling a player, booking a service, or utilizing the facility, you acknowledge and accept these risks on behalf of yourself and the player to the fullest extent permitted by Texas law. All participants are required to sign and maintain an active, separate Participant Waiver, Release of Liability, and Indemnification Agreement prior to utilizing the facility.
11. User Content, Message Boards & Privacy of Minors
The Player Portal includes features such as a message board and a post-purchase review system. You are entirely responsible for the content you post.
Prohibited Content: You agree not to post anything unlawful, harassing, abusive, or infringing.
Photos of Minors: You may only post photos or videos of your own child. You strictly agree not to post, upload, or share media containing other minors without the explicit, prior consent of their parent or legal guardian. Summit Sports Performance is not liable for unauthorized photos posted by third parties, parents, or independent contractors, and we reserve the right to immediately remove any media that violates this policy or generates a complaint.
License: By submitting authorized content, you grant Summit Sports Performance a royalty-free, non-exclusive license to display it in connection with the Service.
12. Code of Conduct & Anti-Harassment
We are committed to providing a safe, positive, and respectful environment for all athletes, families, and staff. Harassment, bullying, excessive profanity, or hostile behavior — whether directed at staff, independent coaches, other players, or parents — will not be tolerated. Summit Sports Performance reserves the absolute right to suspend or terminate the membership and facility access of any individual who violates this policy, without refund for any unused services or prepaid lessons.
13. Lost, Stolen, or Abandoned Property
Summit Sports Performance is not responsible for lost, stolen, or damaged personal property brought into the facility or parking areas. Any items left at the facility and placed in our Lost and Found will be held for a maximum of fourteen (14) days. After 14 days, Summit reserves the right to discard, donate, or otherwise dispose of the abandoned property without liability or compensation to the owner.
14. Video Surveillance
For the safety and security of our athletes, staff, and facility, Summit Sports Performance employs 24/7 video and audio surveillance in all public and training areas of the premises. By entering the facility, you consent to being recorded. These recordings are the exclusive property of Summit Sports Performance and may be used for security, liability, and operational purposes.
15. Electronic Communications & SMS (TCPA)
By creating an account, you consent to receive electronic communications from us, including administrative emails, lesson reminders, and promotional offers. You also consent to receive automated text messages (SMS) at the phone number provided. Standard message and data rates may apply. You may opt out of promotional text messages at any time by replying "STOP," and you may unsubscribe from marketing emails via the link provided in the email. Opting out of marketing communications will not prevent you from receiving critical account or booking alerts.
16. Intellectual Property
All original content, branding, logos, trademarks, and website design associated with Summit Sports Performance and the Player Portal are the exclusive intellectual property of Summit Sports Performance, LLC. You may not copy, reproduce, distribute, or create derivative works from our digital or physical assets without our express written permission.
17. Limitation of Liability
To the maximum extent permitted by Texas law, Summit Sports Performance, LLC, its parent companies, master limited liability companies, any individual series subsidiaries, members, managers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or related to your use of the Service, the Player Portal, or facility operations.
18. Force Majeure
Summit Sports Performance shall not be liable for any delay or failure to perform its obligations under these Terms (including facility closures or cancellation of lessons) resulting from causes beyond our reasonable control, including but not limited to acts of God, severe weather, hurricanes, flooding, power outages, pandemics, government mandates, or facility emergencies.
19. Termination & Changes to Terms
We reserve the right to suspend or close accounts that violate these terms, infringe on the privacy of others, or disrupt facility operations. We may update these Terms of Service from time to time. Material changes will be posted on this page with a new effective date, and your continued use of the Service constitutes your acceptance of the revised terms.
20. Dispute Resolution, Arbitration & Governing Law
These Terms of Service, and any disputes arising out of your use of the Service or facility, shall be governed by the laws of the State of Texas. Any dispute, claim, or controversy arising out of or relating to these Terms of Service, your use of the Player Portal, or any billing matters shall be resolved exclusively by binding arbitration administered in Texas, rather than in court. You explicitly agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
